Terms and Conditions & Waiver: Game On: Gaming Entrepreneurship Workshop

Welcome to the Game On: Gaming Entrepreneurship Workshop, operated by 22nd and Tech ("the Firm," "we," "us," or "our"). These Terms and Conditions, which include a Waiver, govern your and your child's participation in our online workshop. By registering for and participating in the workshop, you, as the parent or legal guardian, fully accept and agree to be bound by these Terms and Conditions.
1. Acceptance of Terms
By completing the registration process for theGame On: Gaming Entrepreneurship Workshop, you confirm that you are the parent or legal guardian of the participating child(ren), are at least 18 years of age, and have read, understood, and agree to all terms and conditions herein, including the waiver of liability. If you do not agree to these terms, please do not register for the workshop.
2. Workshop Description
The Game On: Gaming Entrepreneurship Workshop is a one-hour online educational program designed for children aged 13-17, accompanied by a parent or legal guardian. The workshop aims to introduce basic game design concepts, entrepreneurial principles, and crucial online safety and etiquette as they relate to digital platforms and gaming. The Firm reserves the right to modify the workshop content, schedule, or instructors at its discretion.
3. Eligibility and Parental Supervision Requirement
Age Requirement: The workshop is designed for children aged 13-17.
Mandatory Parental Supervision: At least one parent or legal guardian (over 18 years of age) MUST be present and actively supervise their child throughout the entire one-hour duration of the online workshop. This supervision is essential to ensure the child's engagement, address any immediate needs, facilitate participation, and uphold online safety. The Firm's instructors are not responsible for direct supervision of individual children.
Technical Requirements: Participants are responsible for ensuring they have a stable internet connection, a functioning computer/tablet, and compatible video conferencing software (e.g., Zoom) as specified by the Firm.
4. Online Conduct and Safety
Code of Conduct: All participants (children and supervising adults) are expected to maintain respectful, appropriate, and constructive behavior. Harassment, bullying, hate speech, explicit content, or any other form of disruptive or inappropriate conduct will not be tolerated.
Online Safety Guidelines:
Participants should not share personal contact information (e.g., full names, addresses, phone numbers, email addresses, social media handles) with other participants or instructors during the workshop.
Participants should use appropriate usernames and display names that do not reveal personal identifying information.
Parents are responsible for monitoring their child's interactions and ensuring adherence to these guidelines.
Disruptive Behavior: The Firm reserves the right to remove any participant (child or parent) from the workshop at any time, without refund, if their behavior is deemed disruptive, disrespectful, unsafe, or violates this Code of Conduct. Such decisions are at the sole discretion of the Firm.
5. Payment, Cancellations, and Refunds
Payment: The workshop fee is $50 per parent-child pair and is due in full at the time of registration. All payments are processed through a secure third-party payment gateway.
Cancellations by Participant: Due to the limited capacity and nature of the workshop, all registrations are final. No refunds will be issued for participant cancellations or no-shows. We may, at our sole discretion, offer a credit towards a future workshop session if notification is received at least [e.g., 48 hours] prior to the scheduled workshop, but this is not guaranteed.
Cancellations by the Firm: In the unlikely event that the Firm must cancel a workshop session (e.g., due to technical issues, instructor unavailability, or insufficient enrollment), registered participants will be offered the option to transfer to another available session or receive a full refund. The Firm is not responsible for any other costs incurred by the participant as a result of a cancellation.
6. Intellectual Property
Firm's Content: All workshop materials, including but not limited to presentations, curriculum, handouts, activities, designs, and any other content provided by the Firm, are the sole property of 22nd and Tech and are protected by copyright and other intellectual property laws. Participants may not record, reproduce, distribute, or otherwise use the Firm's intellectual property for commercial purposes without explicit written consent.
Participant-Created Content: Any original game ideas, concepts, or designs created by participants during the workshop remain the intellectual property of the participant. However, by participating, you grant the Firm a non-exclusive, royalty-free, worldwide license to use (e.g., display, promote, or share in marketing materials) any participant-created content for the purpose of promoting the workshop or demonstrating its outcomes, provided such use does not disclose personally identifiable information without additional consent.
7. Disclaimer of Warranties
The workshop is provided "as is" without any warranties, express or implied. The Firm does not guarantee any specific outcomes or results from participation in the workshop, including but not limited to specific skill acquisition, career paths, or financial success. While we strive to provide high-quality educational content, we do not warrant that the workshop will be uninterrupted, error-free, or free of technical issues.
8. Limitation of Liability (Waiver of Claims)
By registering for and participating in the Game On: Gaming Entrepreneurship Workshop, you, the parent/guardian, on behalf of yourself, your participating child(ren), and your respective heirs, executors, administrators, and assigns, hereby release, discharge, indemnify, and hold harmless 22nd and Tech, its owners, instructors, employees, agents, and affiliates (collectively, "Released Parties") from any and all claims, demands, actions, liabilities, damages, losses, and expenses (including legal fees) arising from or in connection with participation in the workshop, including but not limited to:
Any personal injury, accident, illness, death, or property damage sustained by your child or yourself during or related to the workshop.
Any technical issues, internet outages, or software malfunctions beyond the Firm's reasonable control that may disrupt the workshop.
Any claims arising from the conduct or actions of other participants.
Any claims related to the use or misuse of third-party platforms (e.g., Zoom, social media sites) during or after the workshop.
Any claims relating to your child's online interactions or sharing of information, which remains the sole responsibility of the supervising parent/guardian.
You acknowledge that participation in an online educational program involves inherent risks, including but not limited to the potential for technical issues, exposure to online content, and interactions with other participants. You voluntarily assume all such risks.
In no event shall the Released Parties' total liability to you for any damages, losses, or causes of action exceed the amount paid by you for the workshop.
9. Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your or your child's breach of these Terms and Conditions; (b) your or your child's conduct during the workshop; or (c) any violation of applicable law by you or your child.
10. Data Privacy
We are committed to protecting the privacy of our participants. Information collected during registration will be used solely for the purpose of workshop administration, communication, and (if opted-in) future marketing, in accordance with our Privacy Policy [Link to your Privacy Policy - Highly Recommended to have one]. We will not knowingly collect personal information from children under 13 without parental consent beyond what is necessary for participation. Parents are responsible for reviewing and approving the privacy policies of any third-party platforms used for the workshop (e.g., Zoom).
11. Media Release (Optional - Adapt as needed)
By registering, you grant 22nd and Tech permission to use any photographic or video recordings taken during the workshop (including screenshots from online sessions) for promotional, marketing, or educational purposes. This may include, but is not limited to, use on our website, social media channels, and future marketing materials. We will make reasonable efforts to avoid identifying individual children by name in public materials without specific additional consent. If you DO NOT wish for your child's image/likeness to be used, please contact us immediately upon registration at [Your Email Address].
12. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms and Conditions or the workshop shall be exclusively resolved in the state or federal courts located in the State of Georgia.
13. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14. Amendments
The Firm reserves the right to update or modify these Terms and Conditions at any time without prior notice. The most current version will always be posted on our website. Your continued participation in the workshop after any such changes constitutes your acceptance of the new Terms and Conditions.
By completing the registration, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions & Waiver.
